Commercial Lease Disputes

Commercial Lease Disputes

Representation of landlords, tenants, and guarantors, whether bringing or defending claims, in disputes over rent, operating expenses, defaults, guaranties, and the end of a lease.

Common commercial lease disputes

  • Notices of default and three-day notices to pay rent or quit
  • CAM, operating expense, and tax reconciliation disputes
  • Repair, maintenance, and HVAC or roof responsibility
  • Use clauses, exclusives, and co-tenancy provisions
  • Assignment, subletting, and sale of the tenant's business
  • Holdover, surrender condition, and security deposit disputes
  • Claims against personal guarantors

Commercial leases are different from residential leases

California gives commercial parties wide freedom of contract, so the lease language matters more than in a residential tenancy. Many tenant protections that apply to apartments do not apply to commercial space. Notice periods, cure rights, fee clauses, and waiver provisions should be read carefully before responding to a default notice.

Act quickly on a notice

Commercial eviction (unlawful detainer) cases move fast, and the time to respond to a summons is short. Contact counsel promptly if you receive a notice or court papers.

Next step

Talk through your matter with an attorney.

Send a short summary through the intake form or call the office. The firm runs a conflict check before discussing details. Contacting the firm does not create an attorney-client relationship.
